HOW IT WORKS
First and foremost, a big thank you for entrusting BritePool to put you in the driver’s seat when it comes to your online experience. We understand that websites make money from ads, and we think that you should benefit too. We provide a consumer platform that puts you in control of your data and rewards you for sharing your information for ad personalization. Here’s how it works…
We grant you a limited, non-exclusive, revocable license to use the Service for your own personal, non-commercial purpose, and you agree to use the Service only as these Terms say so.
You grant us the right to operate the BritePool Service for your benefit, and to provide you with personalized advertising – meaning we deliver you ads based on your specific interests, preferences and other information to make your online experience relevant and meaningful.
Because we can’t always go it alone, we may work with third parties to make this happen, and you agree to grant them the same right to personalize your advertising.
When you create an account on the Service (“Account”), you certify that you are 18 years or older. You cannot transfer your Account or use of the Service to anyone else. You must keep your Account information confidential and not let anyone else have access. You and BritePoolcan terminate your Account for any reason at any time. Any Terms which by their nature should survive termination will.
WHO OWNS WHAT
BritePool exclusively owns the Service, and all applicable copyrights, patents, trademarks, trade secrets, trade names, logos, and other intellectual property rights thereto (“Intellectual Property”).
We do not own or control any third-party advertising, linked websites or linked services, so we accept no responsibility for the content, privacy policies or practices of these third parties.
DISCLAIMER OF WARRANTIES/LIMITATION OF LIABILITY
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, BRITEPOOL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. BRITEPOOL DOES NOT WARRANT THAT THE SERVICE WILL FUNCTION UNINTERRUPTED OR BE AVAILABLE AT ANY PARTICULAR TIME. BRITEPOOL MAY NOT BE ABLE TO CORRECT ANY ERRORS OR DEFECTS. BRITEPOOL DOES NOT WARRANT THAT THE SERVICE WILL BE FREE FROM LOSS, CORRUPTION, ATTACK, VIRUSES, INTERFERENCE, HACKING OR OTHER HARMFUL COMPONENTS. YOU HEREBY RELEASE BRITEPOOL FROM ANY LIABILITY RELATED TO THE SAME.
TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, BRITEPOOL, NOR ITS DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AGENTS, CONTRACTORS, LICENSORS, SUPPLIERS OR AFFILIATES, WILL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF THE SERVICE, (II) ANY CONTENT OBTAINED FROM THE SERVICE, (III) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE AND (IV) UNAUTHORIZED ACCESS TO YOUR ACCOUNT INFORMATION, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
WAIVER AND INDEMNITY
BY USING THE SERVICE, YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS BRITEPOOL, ITS PARENTS, SUBSIDIARIES, AFFILIATES, LICENSEES AND LICENSORS, AND EACH OF THEIR RESPECTIVE EMPLOYEES, CONTRACTORS, AGENTS, OFFICERS AND DIRECTORS, FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS OR DEBT, AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY’S FEES), ARISING OUT OF (1) YOUR BREACH OF THESE TERMS; (2) YOUR ACCESS OR USE OF THE SERVICE; AND/OR (3) YOUR VIOLATION OF ANY LAW OR THIRD PARTY RIGHTS.
These Terms shall be governed and construed in accordance with U.S. laws of the State of NewYork.
